Defendant was charged in a two-count complaint with the crime of obtaining possession of a controlled substance, Valium, by passing a forged prescription and the crime of attempting to obtain possession of a controlled substance, Darvon, by passing a forged prescription. MCL 333.7407(1)(c); MSA 14.15(7407)(1)(c). Prior to the preliminary examination, defendant moved to quash the complaint arguing that the prosecutor erred in charging him with felonies...
