Defendant was charged with four counts of armed robbery, MCL 750.529; MSA 28.797, and one count of assault with intent to rob while armed, MCL 750.89; MSA 28.284, after four persons were robbed at the Adult Education Center in Lansing, Michigan, on March 25, 1975. He was convicted by a jury on all counts and sentenced to 15 to 40 years imprisonment. He appealed as of right and this Court reversed and remanded for a new trial at the option of the prosecutor...
