THIS CAUSE comes before the court on defendants' motion to dismiss complaint (Fed.R.Civ.P. 12(b)); plaintiffs' motion for class certification (Fed.R.Civ.P. 23); and plaintiffs' motion for summary judgment (Fed.R.Civ.P. 56). Jurisdiction is properly invoked pursuant to 29 U.S.C. § 412 (1976).
