SHERTZ, Judge:

Appellant, Keith Patchett, was convicted in a non-jury trial of violating Section 3314(a) of the Motor Vehicle Code. On appeal, he contends that the trial court erred in its interpretation of the statute, that his conviction resulted in a denial of due process and that it was against the weight of the evidence. We disagree and therefore affirm.
