Defendant first contends the trial court erred in failing to dismiss the charges against him with prejudice for the State's failure to bring him to trial within the time limits set forth in the Speedy Trial Act, G.S. 15A-701 et seq. Defendant was indicted on 27 August 1979. A new indictment for the same offenses was issued 7 January 1980. He filed a "motion for speedy trial dismissal" on 8 February 1980.
