Defendant was convicted by a jury of voluntary manslaughter in violation of MCL 750.321; MSA 28.553. She was sentenced to a prison term of 5 to 15 years and is appealing as of right from this conviction.

Following a violent argument between defendant and her husband, Robin DeRushia, defendant shot and killed her husband on May 27, 1979. The decedent, a veteran who lost a part of one leg in Viet Nam, suffered chronic problems with his legs...
