BANKE, Judge.
Appellee Carithers, a building contractor, brought suit against appellants Prescott and Phillips, charging them with conspiracy to defraud him of monies due under a contract with Prescott for the construction of a prefabricated house. The appellants counter-claimed, charging that the appellee had caused them great mental anguish by constructing the house on the wrong property.
