The plaintiff, John Kyle Niffenegger, an employee of H.J. Curran Contracting Co. (Curran), was injured when an asphalt spreading machine owned by the defendant, Lakeland Construction Co. (Lakeland), ran over his foot. The defendant appeals from a judgment entered on a jury verdict for plaintiff. It contends that the trial court erred in ruling on the motions of the defendant...
