Defendant, Raif E. Washington, was charged with unlawful use of a weapon within 5 years of his release from prison for a felony offense (Ill. Rev. Stat. 1977, ch. 38, par. 24-1(a)(4), (b)). After a jury trial, defendant was found guilty and sentenced to 3 1/2 years in the Department of Corrections.
