ROBERTS, Justice.

George Arnold, Jr. was convicted on two counts of attempted murder and two counts of aggravated assault following a jury trial in the Superior Court, Somerset County, in August, 1979. Those judgments of conviction were affirmed in State v. Arnold, Me., 421 A.2d 932 (1980). In November, 1980 Arnold filed a motion for a new trial on grounds of newly discovered evidence pursuant to M.R.Crim.P. 33.
