This is an appeal by defendant Moran Towing & Transportation Co., Inc., from an order of the Supreme Court (106 Misc.2d 888) granting partial summary judgment to plaintiffs against Moran on the issue of Moran's liability. In our view summary judgment should not have been granted at this stage.
