Before me are cross motions for summary judgment on the awarding of statutory damages for defendant's failure to comply with the Truth-in-Lending Act (TILA), 15 U.S.C. § 1601 et seq. Defendant has also filed a Fourth Affirmative Defense asserting its right to set off plaintiffs' liability to it against any recovery of statutory damages, even though plaintiffs' liability has been discharged in bankruptcy.
