Phillip Shull was charged by a grand jury indictment with child molesting. He was tried to the court and convicted on November 13, 1979. On February 7, 1980, sixty-two days after sentencing, Shull's court appointed counsel filed a motion to correct errors. Despite the tardiness of the motion, the trial court overruled it.
