The plaintiff, John Foley, a Boston police officer, brought a negligence action against the defendant Kibrick for personal injuries sustained when the police cruiser in which the plaintiff was a passenger collided with a motor vehicle operated by the defendant. Thereafter, the defendant brought a third-party complaint against Officer Edward Berg, the operator of the police cruiser at the time of the accident, claiming that the plaintiff's injuries were caused...
