In October, 1977 the defendants purchased a 57-acre tract of "pasture" land in Atkinson County, with the intention of establishing an egg farm. Subsequently, 26 chicken layer houses were built and on March 15, 1979, 40,000 chickens were brought in. The defendants began transacting business under the trade name, "Frances Egg Farm."
