SWANSON, J.

Larry L. Dorman was convicted by a jury of nine counts of second degree theft and one count of first degree theft under RCW 9A.56.020(1)(a).1 The theory of the State's case was that Dorman, as trustee of a trust account, had appropriated for his own use money deposited in the account.
