OPINION

TAYLOR, P.J.

On this appeal from a judgment of conviction entered after defendant, J.W. Axtell, entered a nolo plea to one count of kidnaping for robbery (Pen. Code, § 209, subd. (b)), the only question is whether the trial court abused its discretion and deprived him of due process by sentencing him to prison. For the reasons set forth below, we have concluded that the judgment must be affirmed.
