This cause came on to be heard upon an appeal from the Court of Common Pleas of Hamilton County.

The defendant-appellant, Herbert Lockhardt, was tried by the court for the unlicensed sale of drugs in violation of R.C. 4729.28. At trial Police Officer Disbennett, describing the offense, testified, "Mr. Caudell [sic] handed a tissue to Mr. Caudell." Officer Disbennett further testified...
