This article 78 proceeding was brought by James R. Harvey, District Attorney of the County of Ontario, to compel the County of Ontario to pay him the compensation as established by sections 183-a and 221-d of the Judiciary Law. Section 183-a of the Judiciary Law requires Ontario County to pay its District Attorney a salary equivalent to that of the County Court Judge for Ontario County.
