Defendant contends in his first assignment of error that the trial court erred by admitting hearsay testimony over his strenuous objection. The alleged hearsay testimony was given by defense witness Jerome Miller. Miller testified that Buck Whitley had told him that defendant "stomped" the deceased in the face with his shoes and hit the deceased with the pot.
