On July 30, 1981 at about 10:30 in the evening, Lebanon City Police Officer, Gary Boyer, Sr., was dispatched to the vicinity of 12th and Cumberland Streets. There he found three men sitting on the bridge talking. The officer ordered the men to leave the area but defendant Samuel Gonzalez refused. The officer told him that he would return in a few minutes and if Gonzalez was still there a citation would be issued.
