This case came before us on an appeal by Waikiki Resort Hotel, Inc., plaintiff below, from a judgment of the First Circuit Court, which:

(a) dismissed with prejudice the complaint filed by plaintiff in that court against the City and County of Honolulu; Ernest Yuasa, director and superintendent of the Building Department of the City and County of Honolulu; and Herbert K. Horita, as defendants, in Civil No. 50463; and (b) affirmed...
