OPINION

BRETT, Presiding Judge:

Mark Edward Cole, the appellant, was convicted of Assault and Battery with a Dangerous Weapon, Case No. CRF-79-1346, and Rape in the First Degree, Case No. CRF-79-1347, in the Oklahoma County District Court. The jury imposed consecutive sentences of five (5) years for the Assault and Battery conviction, and forty (40) years' imprisonment for the Rape.
