Willie Higgins, a black, was employed by the Oklahoma Employment Security Commission in 1967. He resigned in October 1976, claiming the Commission had failed to promote him because of his race. After exhausting his administrative remedies, he brought this action alleging discrimination in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000e et seq.
