Plaintiff, Alfred Crochet, Jr., instituted this suit against defendant, American Tobacco Company, contending that he is entitled to workmen's compensation benefits due to a back injury allegedly sustained while plaintiff was in the course and scope of his employment with defendant. Plaintiff additionally prayed for an award of penalties and attorney's fees contending that the defendant was arbitrary and capricious in its refusal to pay benefits allegedly...
