On September 20, 1979, defendant-appellant Johnny Garza Garrido was charged in the District Court of the Eighth Judicial District of the State of Montana with two counts of felony theft under section 45-6-301(1)(a), MCA. The county attorney and the defendant entered into a plea agreement. Defendant was subsequently sentenced to five years in the Montana State Prison and designated a nondangerous offender....
