INTRODUCTION

Grimes appeals from the grant of summary judgment for defendants on his claims of violations of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001 et seq., and the denial of his cross motion for summary judgment on count three of his complaint. We affirm.
