The plaintiff, Thomas H. Duffy, commenced two separate actions in Kent County Superior Court to compel partition of a parcel of real estate located in West Warwick, Rhode Island. The separate actions were consolidated and the trial justice dismissed them on the defendants' motion1 that plaintiff lacked standing to compel partition.
