BUSSEY, Judge.

Appellant was convicted by a jury of Assault and Battery in the Municipal Criminal Court of the City of Tulsa, Case No. 259476, and sentenced to thirty (30) days in jail. On appeal, he raises five assignments of error, only two of which it will be necessary for this Court to address.
