Appellant Thomas was found guilty of robbery and kidnapping in 1966. He appealed from this conviction and was granted a new trial. Thomas v. State, (1969) 251 Ind. 546, 242 N.E.2d 919.

On March 27, 1969, after remand, the State filed additional charges. Upon retrial Thomas was found guilty of accessory after the fact to theft, and accessory after the fact to kidnapping...
