No. 12696.

405 So.2d 1112 (1981)

Geraldine C. Amedee, Wife of/and Richard P. AMEDEE v. SOUTHERN BAPTIST HOSPITAL, Dr. R.L. Chrestman, Dr. Michael E. Carey, Dr. James Rogers, Dr. Richard L. Strub, and Dr. G.S. Peterson.

Court of Appeal of Louisiana, Fourth Circuit.

October 5, 1981.

Attorney(s) appearing for the Case

Lawrence D. Wiedemann and Edmond Golden, Wiedemann & Fransen, New Orleans, for plaintiffs-appellees.

C.A. Kiger, New Orleans, for Southern Baptist Hospital.

Before REDMANN, SCHOTT and KLEES, JJ.

SCHOTT, Judge.

This appeal from the trial court's dismissal of plaintiffs' suit on the ground of prematurity is an attack on the Louisiana Medical Malpractice Act, LSA-R.S. 40:1299.41 et seq. on the ground that it is unconstitutional. That question was settled in Everett v. Goldman, 359 So.2d 1256 (La.1978).

The judgment is affirmed.
