This is an appeal from a summary judgment rendered in favor of defendants, lessees under thirteen coal and lignite leases, ordering that plaintiffs, lessors, take nothing by their suit. Plaintiffs filed suit for declaratory judgment and a decree cancelling the leases and/or an alternative decree requiring defendants to proceed in the exploration and development of plaintiffs' leased lands in accordance with an alleged implied covenant to develop within...
