Introduction

In an earlier opinion in this case, this Court concluded that the Ohio State Board of Education and the Ohio Superintendent of Public Instruction — the State defendants — in addition to the Columbus defendants violated the constitutional rights of certain Columbus school children. Penick v. Columbus Board of Education, 429 F.Supp. 229
