The appellant, Christopher M. Miller, hereinafter referred to as the defendant, was charged, tried by a jury, and convicted in the District Court of Payne County, Case No. CRF-79-316, for the offense of Grand Larceny, in violation of 21 O.S. 1971, § 1701.
