LEIGHTON, District Judge.

This action is before the court on plaintiff's motion for an award of costs and attorneys' fees. Plaintiff's complaint had alleged that he had been discharged from employment by Playboy because of his age, in violation of the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq. A settlement was eventually agreed to, the terms of which are irrelevant for the purposes of the motion now before the court...
