The defendant, Ruperto Sandoval, was convicted of trafficking in heroin contrary to Section 30-31-20(A)(2), N.M.S.A. 1978 (Repl.Pamp. 1980). The defendant sought review by the Court of Appeals which reversed and remanded to the trial court.
