During the early morning hours of July 27, 1979, the prosecutrix was awakened in her Montgomery apartment by a man on top of her. He covered her mouth with his hand and called her by name saying that she would not be harmed if she did not scream. The attacker tore away the prosecutrix's nightgown and raped her.
