Between 7:00 and 8:00 on the morning of April 9, 1978, Roger Rackley was shot in the chest while he was in a garage at the home of the appellant's sister, Alta Garrison, at Hector in Pope county. An ambulance was summoned at once, but Rackley died before he could be taken to a hospital.
