The Administrator of the United States Environmental Protection Agency (EPA) appeals from a judgment of the Eastern District of Michigan permanently enjoining the enforcement of the Emission Control Performance Warranty Regulation. By a previous Order we vacated the district court's injunction and transferred the case to the United States Court of Appeals for the District of Columbia. That court declined jurisdiction.
