This is an appeal by the Commonwealth from an order of the Fayette Circuit Court which dismissed a murder indictment against Larry Brown. The order was entered based upon the Commonwealth's representations that several pre-trial rulings of the court had the effect of preventing the Commonwealth from using all the evidence it had that was reasonably calculated to convict Brown of the offense charged.
