The defendant originally pleaded guilty to one count of a four count indictment and was sentenced thereon. On a subsequent motion under 28 U.S.C. § 2255, the judgment was vacated by the Court of Appeals and the defendant was given an opportunity to plead again. The mandate issued on December 22, 1980.
