DENNIS, Justice, concurring.

I respectfully concur. Although I feel that the defendant was denied due process because he was convicted upon a charge of which he was not given adequate notice and against which he had no chance to defend, I disagree with the majority's rationale suggesting that insufficiency of the evidence is the basis for the reversal of the defendant...
