Defendants appeal from a deficiency judgment awarding James V. Justice the balance owed on a promissory note.1 Entitlement to recovery is in issue; however, the amount of the judgment is not.

According to the pleadings and sparse evidence in the record, Justice instituted suit via ordinaria for the unpaid balance due on a note executed and signed by May and Roy Caballero on August 3, 1972 and made payable to him...
