Plaintiff, Jerry Wayne Jenkins, was seriously injured when the pickup truck he was driving was struck by a train at a crossing in Plain Dealing, Louisiana. He employed Charles E. Tooke, Jr., an attorney, who with plaintiff's consent associated John B. Morneau, another attorney, to pursue a tort claim against the railroad company.
