Plaintiff, Troy Culp d/b/a Arkansas Stone Company, sued defendant, James E. Bearden, for recovery of the purchase price of a fireplace. Defendant answered that the fireplace was defective and unfit for the use for which it was intended and prayed for rescission of the sale.
