TRANSAMERICAN PROP., INC. v. CITY OF RIVIERA BEACH

No. 80-24.

400 So.2d 803 (1981)

TRANSAMERICAN PROPERTIES, INC., Appellant, v. CITY OF RIVIERA BEACH, Appellee.

District Court of Appeal of Florida, Fourth District.

Rehearing Denied July 31, 1981.

Attorney(s) appearing for the Case

Kenneth J. Scherer of DeSantis, Cook, Meehan, Cohen, Gaskill & Silverman, P.A., North Palm Beach, for appellant.

Charles W. Musgrove, West Palm Beach, and Allan V. Everard, Riviera Beach, for appellee.

HURLEY, Judge.

Plaintiff/appellant brings this appeal from a final order dismissing its complaint for equitable relief against the City of Riviera Beach. The trial court construed plaintiff's amended complaint to be a direct attack upon the city's denial of a petition for zoning variance and, therefore, held that plaintiff's exclusive remedy was a petition for certiorari. See Centex Homes Corp. v. Metropolitan Dade County, 318 So.2d 149
