Lucian N. Butler, seeking damages for injuries sustained in an automobile accident, filed this negligence action against Isaac Eugene Yates, the driver of the car with which he collided. At the conclusion of Butler's evidence, Yates made a motion to strike the plaintiff's evidence on the ground that Butler was guilty of contributory negligence.
