This case arises under the uninsured motorist statute, T.C.A. §§ 56-7-1201 to -1206, but it arises in somewhat unusual circumstances.

Appellants were plaintiffs in a tort action in which a liability insurance carrier conducted the defense of the alleged tort-feasor. Not until after trial and final judgment did the plaintiffs learn that the defendant's insurance carrier had defended the action under a reservation...
