On September 18, 1975, after a jury trial, defendant was convicted of theft by deception, official misconduct, and conspiracy to commit theft. (Ill. Rev. Stat. 1977, ch. 38, pars. 16-1(b), 33-3, and 8-2.) He was sentenced to 2 years' probation solely on the offense of theft.
