This case is before me on remand from the Fifth Circuit Court of Appeals, which reversed my earlier decision denying plaintiff's motion for judgment of default. Shillingford v. Holmes, 634 F.2d 263 (5th Cir., 1981). Earlier I dismissed the instant suit because I did not believe that the plaintiff had proved a claim under 42 U.S.C. § 1983.
